Terms of Service

Effective Date: December 1, 2024

Welcome to Jared Kinley Photography (“we,” “our,” or “Jared Kinley”). By engaging our photography services, you (“Client”) agree to the following terms and conditions:

1. Payment and Refund Policy

  • All payments are final, and no refunds will be provided after payment has been made, except in cases where services cannot be rendered due to circumstances solely attributable to Jared Kinley.

  • A deposit will be required to secure your booking. This deposit is non-refundable and will be applied to the total cost of the service.

2. Photo Usage and Licensing

  • Any use of photographs for advertising, promotional purposes, or commercial endeavors requires a usage and licensing fee to be agreed upon in advance.

  • Licensing terms, fees, and usage rights will be documented in a separate agreement, which must be signed by both parties before the photographs can be used for such purposes.

  • Unauthorized use of photographs for commercial purposes is strictly prohibited and may result in legal action.

3. Credit and Attribution

  • Jared Kinley must be credited as the photographer in all published works unless a prior written agreement specifies otherwise.

  • Credit should appear as “Photo by Jared Kinley” or similar, with any applicable tags or mentions on social media platforms. @jared.kinley for instagram. @jaredkinleystudio on facebook.

  • Failure to provide proper credit may result in additional fees or penalties.

4. Delivery of Photographs

  • Final edited photographs will be delivered within the agreed-upon timeline. Delivery times may vary based on the nature and scope of the project.

  • Photographs will be provided in the agreed format (WeTransfer link or online storage). Additional formats may incur extra fees.

5. Copyright and Ownership

  • All photographs remain the sole intellectual property of Jared Kinley unless explicitly transferred in writing.

  • Clients receive a license for personal use only, unless otherwise specified in a separate licensing agreement.

6. Liability

  • Jared Kinley will not be held liable for events outside of our control, including but not limited to equipment failure, natural disasters, or unforeseen circumstances that prevent service delivery.

  • Jared Kinley shoots with film. In the unlikely event the film process fails, Jared is not held liable. The Client and Jared Kinley will discuss options not limited to a reshoot.

7. Model Release

  • By engaging our services, you grant Jared Kinley the right to use photographs from your session for promotional purposes, including portfolio display and social media, print work, and reselling the image in forms of but limited to printing and/or showcasing and advertising.

8. Modification of Terms

  • Jared Kinley Photography reserves the right to update or modify these terms at any time. Changes will be communicated to clients before taking effect.
